Heinonen & Co advised Schwan-STABILO Schwanhäußer GmbH & Co. KG in protecting their globally renowned STABILO BOSS highlighter pens. With over 170 years of pen manufacturing expertise, Schwan-STABILO has established a strong reputation for quality and innovation, with their STABILO BOSS highlighters protected through multiple trademark and design registrations.
A major Finnish retail chain had been producing and selling own-brand highlighter pens that Schwan-STABILO believed copied the design, shape and overall appearance of the original STABILO BOSS highlighters. Schwan-STABILO argued this created a likelihood of consumer confusion and gave the retailer unfair advantage from the STABILO BOSS brand’s distinctiveness, reputation, and goodwill.
The matter was resolved amicably, with the Finnish retailer agreeing to cease manufacturing and selling the contested products. Heinonen & Co successfully safeguarded the integrity of the STABILO BOSS design.
